Starting January 1, 2022, Illinois Protecting Household Privacy Act (PHPA) takes effect. The act prohibits Illinois law enforcement agencies from obtaining household electronic data or directing private third parties to acquire household electronic data without a warrant except when consented to or in specific emergencies. The act excludes personal computers, cell phones, smartphones, tablets, modems, routers, wireless access points, or cable set-top boxes serviced by a cable provider. Therefore, it focuses on virtual assistants, video doorbells, smart speakers, security cameras, and smart appliances that connect to the internet. Illinois is the first state in the US that has passed such legislation.
