EU member states fail to adopt common position on ePrivacy reform

On November 12, the Permanent Representatives Committee of the Council of the European Union rejected the latest draft of the ePrivacy Regulation. Despite multiple compromise proposals from the Finnish presidency of the Council of the EU, member states have again failed to adopt their negotiating mandate on the draft ePrivacy Regulation, which was proposed by the European Commission in January 2017. According to Jennifer Baker from IAPP, the biggest issue dividing member states is the processing of electronic communications data for the purposes of prevention of child abuse imagery. It is now unclear whether the next European will consider withdrawing or re-drafting the legislative text.
