Ombudsman asks European Commission about AI use in decision-making

The European Ombudsman, Emily O'Reilly, has written to the European Commission (EC), seeking clarification on its strategies for adopting and employing artificial intelligence (AI) in its decision-making processes.

Acknowledging the rapid advancements in AI technology, the Ombudsman emphasised the potential benefits it offers in enhancing the quality and efficiency of work. However, O'Reilly also raised significant concerns regarding the potential drawbacks associated with AI, including issues related to accuracy, potential biases, explainability, and the necessity for human oversight. Stressing the importance of AI complementing human judgment rather than replacing it entirely, she underscored the responsibility of public administrations to maintain this balance.

The inquiry by the Ombudsman to the Commission focuses on three specific areas: the utilisation of AI in analysing public feedback, identifying potential breaches of EU competition regulations, and managing complaints. Questions posed by the Ombudsman revolve around various aspects of the Commission's AI usage, including the automation of tasks, decision-making protocols concerning AI implementation, transparency in decision-making processes related to AI, and mechanisms for ensuring accountability.

The inquiry was opened on 15 March, and the Ombudsman set a deadline of 14 June 2024 for the Commission to provide a response.
